Unauthorised Occupants   
Unauhorised occupants are still covered by the Landlords & Tenants Act.  To remove them you need a Court Order - make no mistake.
  • Firstly, there is no such legal term as 'Squatters Rights'. The laws governing possession of a property are quite clear and rules are established for possession and tenure.
  • The Landlord cannot physically remove anyone. if you feel someone has broken laws to enter your property, call the Police. They will remove them.
  • If the occupant gained possession legally, but has then refused to leave, the Landlord must use the Courts. 
  • Any physical or mental intimidation is viewed very seriously by the Courts and the fines can be severe in the extreme.
  • If you, the Landlord, live in the property with the unauthorised occupant, then you can arrange for the Police to remove them immediately, however, you cannot move in merely to force them out.
  • If a legal tenant has allowed an undesirable person to reside with them at the property, it is difficult to obtain possession from the Courts on this basis alone, even if it is forbidden by the Agreement.
