Property Damage   
It would have to be a severe situation for a Judge to award possession to the Landlord because of damages made to the property by the Tenant
  • It may sound ridiculous, but it is very difficult to gain possession through the Courts for anything other than rent arrears or end of contract.
  • The situation would need to be pretty extreme and/or critical to the safety of others before a Judge would evict someone on that basis alone.  It would probably take months of chances and second chances before the Court would lose patience sufficiently with a Defendant to remove them from their home.
  • The Landlord needs to stay on top of the condition as there is little recourse other than through the deposit, which is normally limited to one months' rent.
  • Prepare a thorough condition report (inventory) and get the tenant to run through it with you and sign it.
